General Conditions of Sale
JAPONMANIA.COM is a website of JAPONMANIA SARL (1 Rue Caïs de Gilette 06300 Nice, France), hereinafter referred indifferently to as JAPONMANIA SARL or JaponMania ™.
The purpose of the following general conditions of sale is to govern the rights and obligations of the parties in connection with the sale of products and services offered by JAPONMANIA SARL to its customers.
In the absence of special contract between the customer and JAPONMANIA SARL, sales are subject to these general terms and conditions.
Accordingly, the customer agrees to have read and accepted these terms of sale before placing an order. The validation by the customer of his order implies full and unreserved acceptance of these terms and conditions.
JAPONMANIA SARL reserves the right to modify these terms and conditions of sale at any time. The new provisions, if any, will be applicable only to sales made after the changes occurred.
The customer declares to be of above the legal for entering into a contract, or to hold parental permission for entering into a contract.
PRODUCTS DESCRIPTION and LIABILITY
Each product sold by JAPONMANIA™, comes along a description as accurate as possible on the product details page. JAPONMANIA™ takes no responsibility for the accurateness and fullness of the information available on this website.
The website may also contain information from third-party sources, as well as links to external websites. JaponMania™ does not guarantee the content or accuracy of the information contained from these sources and shall in no case be liable for damages resulting from the use of this information.
Although setup with much care, the picture(s) illustrating a product and its description cannot always reflect with 100% accuracy the product characteristics and JaponMania™does not warrant that product descriptions or other content of this site is complete, current or error-free, and therefore JaponMania™ responsibility cannot be engaged.
All descriptive information and prices may be changed at any time without notice.
PRICES AND TAXES
The price of each product is shown on the product data sheet. All prices are in Euros and VAT free (VAT not applicable, article 293 B of the Code général des impôts) for France and the European Union, and exclude shipping costs.
For overseas departments and territoiries, as well as all countries outside of the European Union, customer's package may be subject to customs duties and/or import taxes upon entry in his country. Such taxes are not included in the prices billed Japonmania™, and the customer is entirely responsible for any such duties or taxes. Japonmania™ cannot predict which package will be taxed and which won't be, and cannot be held responsible for the enforcement of customs duties or import taxes on the customer's parcel.
Despite our best efforts, it may happen that some products contain pricing errors. If we discover an error in the price of products you have ordered we will inform you as soon as possible. You will be given the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you JaponMania™ reserves the right to cancel the order for the products concerned. Cancelled orders or products which have already been paid for will be refunded.
Payments are done in Euros. We accept the following payment methods:
Unless prior consent from Japonmania.com, and to avoid fraudulent orders, all packages are deliver to the credit card holder (billing) address.
ORDERING AND ORDER CONFIRMATION
All products are in principle available only if in stock. Japonmania™ reserves the right to inform the customer of any supply problem, and in case a product cannot be restock to cancel the customer's order.
Japonmania™ verify all orders, and reserves the right to cancel any order for which we determined there is a fraudulent risk, real or assume, or any order from a customer with whom there is payment dispute, or a history of incidents, without prejudice to any claim for damages and interest.
In case of order cancellation by Japonmania™, and if the customer already paid for the product(s), Japonmania™ will make a full refund.
Japonmania™ cannot be held liable for shipping products for which the importation is restricted by any laws or regulations in the country where the products are delivered. If in doubt, the customer should verify by himself/herself if he/she is authorized to import such products.
Shipments are processed from Monday through Friday (except holidays).
Delivery timeframes listed below begin from the date of dispatch, and do not take into account the time for payment authorization, order preparation, and packaging (1 to 2 business hours after payment validation).
These Delivery timeframes are just average estimates, and Japonmania Sarl cannot be held responsible for delayed shipments by the carrier.
We offer flat delivery costs, except for France Dom&Tom. This flat rates and included services depend on the destination and the value of the parcel.
Our current shipping methods are listed in the chart below.
Colissimo and Colissimo international flat rates apply only to parcels weighing less than 10Kgs (or 5kgs for destinations outside Europe). For larger packages, please contact our customer service or split up your order.
"Priority International Small Packets" flat rates are only available for parcels weighing less than 2kg and whose size -all sides added- don't exceed 90cm (offer limited to the following destinations: Europe, North America, Mexico, Asia, Oceania).
In application of article L121-21 of the French Consumer Code, the customer has a period of fourteen calendar days from the date of receipt of the order, to return a product that they are not satisfied with. Any claim made after this deadline will not be accepted.
To ensure prompt and effective handling, any article subject to a request for return must first obtain a return number from our Customer Service, through the Return section of his Japonmania account. The customer can also make his request by registered postal mail.
The customer must return the item (s) in question unused, in their original undamaged packaging, in perfect condition, complete (accessories, booklets, warranty ...) with a copy of the invoice.
Returns for products sold in set, and for which the customer has used one of the set items, or products that can be reproduced and have been unsealed such as, but with no limitation books, magazines. CD, DVD, CD-Rom, video games, software cannot be returned.
For hygiene reasons, socks that have been unpacked can not be returned under this right. Therefore, and without prejudice to the legal warranties, in this case, socks will not be taken back or exchanged.
The customer is responsible for the shipping costs to return a product, except in case a wrong or defective (broken or missing part) item has been shipped, and in such a case only upon presentation of proof of the shipping costs incurred.
Japonmania™ does not accept COD shipments.
If the Client had received free shipping because of the amount of his order and if in case of return or retraction the buyer decides to keep one or more items of his order but the total of these become less than the amount triggering the free shipping charges, the shipping charges that would have been applied will then be deducted from the amount reimbursed.
The same rule shall apply if the Client had used a discount code offering free shipping under certain conditions and that the return of one or more products makes this coupon ineligible for the remaining products of the order.
The customer is sole responsible for the risks associated to the shipping of a return product. We recommend the customer to pack the item properly to protect it from damage, and to select a shipping method allowing tracking of the package.
The customer can opt either for a store credit or a refund. In the case the customer is asking a refund for non-compliance, upon receipt and verification of the non-compliance claim or defect, JaponMania SARL will give the customer the option to choose from an exchange of the defective product (limited to stock availability), a refund or a store credit.
The Client is responsible for providing with a complete and accurate postal address for the delivery.
If the parcel is returned by the carrier because of incomplete or inaccurate delivery information, the customer will be refunded the products full price, excluding delivery fees. Delivery costs shall remain the Customer expense.
FORCE MAJEURE EVENTS
The occurrence of a force majeure event suspends the contractual obligations of both parties, until the extinction of the causes that generated the force majeure. JaponMania™ and the customer expressly agree that the following events may reasonably be considered as cases of force majeure: storms, floods, natural disasters, nuclear accidents, internal or external strikes, riots, insurrections, sabotage, war, blackouts, destruction or damage to any equipment or premises.
The sell contract between JAPONMANIA SARL and the customer, as well as the present conditions, shall be governed by and construed in accordance with the French law.
Any litigation or disputes between the parties shall be brought only before the competent court in France.
In the event that any provision of these conditions of sale were to be declared invalid in whole or in part, or deemed unwritten, the remainder of these conditions of sale will remain valid and applicable. The failure of either party to assert any right under these conditions of sale will not be considered to be a waiver of that party's right, and the said right will remain in full force and effect.
